Nom Nom Bites – Terms & Conditions
1. General
By placing an order with Nom Nom Bites (“we”, “us”, “our”), you agree to the following Terms & Conditions. These apply to all orders placed via our website, phone, or in person.
2. Orders & Payment
* All orders must be paid in full at the time of placing the order unless the customer has an approved account with us.
* Customers with approved accounts may be invoiced and are not required to pay at the time of ordering.
* We accept online payments via secure third-party payment providers (e.g. Fat Zebra).
* Orders are not confirmed until payment has been successfully processed or the account order has been accepted.
* Prices are listed in Australian Dollars (AUD) and include GST unless stated otherwise.
3. Pricing & Fees
* Prices are subject to change without notice.
* A payment processing fee may be applied at checkout to cover transaction costs.
* All product pricing is displayed clearly prior to checkout.
4. Order Cut-Off Times
* Standard order cut-off time is **12:00pm (midday) the day prior to pickup or delivery**.
* Some products may have different cut-off times, which will be clearly specified at the time of ordering.
* Orders placed after the cut-off may not be accepted.
5. Order Changes & Cancellations
* Changes or cancellations must be made prior to the applicable cut-off time.
* Changes are subject to availability and may not always be possible.
* Orders cancelled after the cut-off time may result in partial or full loss of payment due to preparation and ingredient costs.
6. Pickup Orders
* Orders must be collected on the selected pickup date.
* As most products are prepared fresh, pickup times are approximate and may vary slightly.
* It is the customer’s responsibility to collect orders on time.
* **Failure to collect an order (no-show) will result in forfeiture of payment.**
* We are not responsible for product quality once the order has been collected.
7. Catering Orders
* Catering orders may require additional notice depending on size and complexity.
* Specific delivery or setup requirements must be communicated at the time of ordering.
* Orders are prepared based on the details provided at the time of confirmation.
8. Delivery (if applicable)
* Delivery availability and fees depend on location.
* We aim to deliver within the agreed time window but cannot guarantee exact delivery times.
* Risk transfers to the customer upon delivery.
9. Product Availability & Substitutions
* All products are subject to availability.
* We reserve the right to substitute ingredients or products with similar alternatives where necessary.
* We will make reasonable efforts to notify you of significant changes.
10. Allergies & Dietary Information
* While we take care in food preparation, our products are made in a kitchen that handles allergens including (but not limited to) gluten, dairy, eggs, nuts, and soy.
* We cannot guarantee that any product is completely free from allergens.
* Customers with severe allergies should contact us prior to ordering.
11. Quality & Complaints
* If there is an issue with your order, you must notify us as soon as possible (preferably within 24 hours).
* We may request photos or additional information to assess the issue.
* Refunds, replacements, or credits are issued at our discretion.
12. Refund Policy
* Refunds are not provided for change of mind.
* Approved refunds will be processed via the original payment method where possible.
13. Website & Ordering System
* We aim to ensure the website is accurate and functional, but errors may occur.
* We reserve the right to cancel or amend orders affected by pricing or system errors.
14. Limitation of Liability
* To the extent permitted by law, Nom Nom Bites is not liable for any indirect or consequential loss arising from the use of our products or services.
* Our liability is limited to the value of the goods supplied.
15. Privacy
* Customer information is handled in accordance with our Privacy Policy.
* We do not sell or share personal data with third parties except where required to process orders.
16. Governing Law
* These Terms & Conditions are governed by the laws of Victoria, Australia.
